Risk assessments are a legal duty for all businesses, including the self-employed. If there are five or more employees within the organisation the significant findings of a risk assessments must be recorded. A competent person must carry out the risk assessment, but not every business has someone with the knowledge, training, ability and time to address this process comprehensively. Guy will write or review your risk assessments and safety policy and help you to implement them.
New research commissioned by the Institution of Occupational Safety and Health (IOSH) has found organisations adopting a proactive approach to health and safety management tend to be more profitable and have lower accident rates.
A legal prosecution has only to prove there has been an exposure to risk, and then it is for the employer under section 40 of the Health and Safety at Work etc Act 1974, to prove they took all reasonably practicable steps to avoid the exposure.
